SOCIAL SECURITY BENEFITS TO INCREASE FOR U.S. CITIZENS IN ISRAEL!

The Senate has officially passed H.R. 82, the Social Security Fairness Act of 2023, marking a monumental day for U.S. citizens living abroad. For years, countless U.S. expats in Israel have faced unfair reductions in their Social Security benefits due to the Windfall Elimination Provision (WEP) triggered by their Israeli pensions. Today, that era takes a giant step closer to ending!

What This Means for U.S. Citizens in Israel

This incredible milestone means no more WEP deductions for U.S. citizens in Israel. They can now enjoy their full Social Security benefits without worrying about reductions caused by their Israeli pensions.

Understanding WEP and Its Impact

The Windfall Elimination Provision (WEP) has long been a source of frustration for U.S. citizens living in Israel and other countries. Established in the 1980s, WEP was designed to adjust Social Security benefits for individuals receiving pensions from jobs that did not contribute to the Social Security system.

The intent was to prevent individuals with these pensions from being credited as long-time, low-wage earners, which would have entitled them to disproportionately higher Social Security benefits.

Here’s how WEP affected retirees. Social Security benefits are calculated using a formula that applies different percentages to a worker’s average indexed monthly earnings (AIME). Most workers’ first portion of their earnings is credited at 90%. However, under WEP, this rate could be reduced to as low as 40%, depending on the years the worker paid into Social Security.

This reduction resulted in significantly lower monthly payments for those affected, especially individuals with less than 30 years of substantial Social Security-covered earnings.

For U.S. citizens in Israel, WEP was triggered by Israeli corporate pensions, even though these pensions are part of a completely separate system. While safeguards like the WEP guarantee capped reductions to no more than half of the monthly pension amount, the financial impact on expats was often severe and felt deeply unfair.

With the repeal of WEP through H.R. 82, affected retirees can look forward to receiving all of the Social Security benefits they have earned.

When Do These Changes Take Effect?

The changes in H.R. 82 are set to apply to Social Security benefits for months after December 2023. This raises an important question: will individuals who had their benefits reduced by WEP in 2024 be able to receive back pay for the months impacted? Additionally, will adjustments to benefits be made automatically, or will affected individuals need to take action? We’ll keep you updated as more details emerge!

While the bill still needs the President’s signature to become law, all signs indicate this is happening soon. There’s every reason to believe this historic moment won’t be delayed. More updates will come as we celebrate this victory and watch it become officially signed into law. For now—cheers to a brighter future for retirees abroad!
